Another Plan to Resolve the Problem on Medical Malpractices

A recent study conducted by the U.S. Department of Health & Human Services (HHS) Agency for HealthCare Research and Quality (AHRQ) refutes our insights that physicians are indisposed to reveal medical malpractices and discover its preventive measures. This finding also shows that the doctors choose to talk on this topic with their colleagues instead of sharing it with the authorities due to their doubt in our present system of reporting.

Because of these discoveries, the HHS is now working on some programs to develop the implementing rules of the Patient and Quality Improvement Act of 2005 or the Patient Safety Act. This helpful law provision aims to allow the creation of Patient Safety Organizations with the duty of collecting, aggregating and analyzing classified information voluntarily testified by health professionals.

With such, the PSO will be using this gathered information to recognize the warm holes in the medical practices and subsequently find out strategies on how to avoid these mistakes. Thus, the patients may benefit on the new approaches that reduce dangers and improve the quality of providing cure to illnesses.

Absolutely, this government plan is a positive development. We just have to think of those hundreds or even thousands of patients who are being victimized by incompetent medical professionals. Instead of finding cure to their ailments, many of them leave the clinics and hospitals with worse health conditions.

Luckily, these people are entitled of some legal remedies to reimburse the damages caused by the erroneous medical procedures. If not with the help of medical malpractice attorneys who are experts in handling their clients’ claims, these individuals may just be left unaided and suffering.

On the other hand, our laws are just enough to protect the sick people who are seeking treatment. It is just that most patients are not fully aware of their rights. Hence, they end up without being helped by their neglectful doctors.

Finally, I think that the key here, aside from our government efforts to improve the quality of health services, is proper information dissemination about the rights of the patients.

Things To Ponder Before Buying An Investment

Many of us try to make future savings by buying shares as investments, which is good business sense. However, some people are wary of buying shares, especially when these are considered minority stakes in a corporation.

To allay the fears of people who have minority shares in business, I will share with you an article I read, “Minority Shareholder Rights in California”, posted in March 2007. The article explains how the rights of minority shareholders are protected in California’s corporate setting.

According to the article, minority shareholders enjoy an important right which cannot be compromised by any corporate bylaw or majority shareholder action. This valuable right is the right to access of information.

Under California laws, shareholders have the right to inspect the corporation’s two important books – the record of shareholders and accounting books, records, and minutes of proceedings.

Why is this important? Because having access to this information will give you a hint on what is happening with the company and determine whether you are losing or gaining from your investment.

This is an important right a minority shareholder should keep in mind as protection for his investment.

Added to this, if a lawful inspection is refused, the courts may intervene and compel the corporation to forfeit the requested information.

Buying shares and stocks often involve risks. Here’s what to consider before buying shares or investments:

  • That you are part owner of the company – A company’s gain or loss is yours too.
  • Price shares may fluctuate in the short run.
  • Invest for a long-term plan. In buying shares, it is always good to buy low and sell high, which means that you should buy shares when the price is low and sell them high when demand increases.
  • Decide first how much you want to invest – In finance, you have to remember that the greater the investment, the higher the risks involved.
  • Research and do some homework before deciding on buying a certain share.

There are many ways of knowing your other rights as minority shareholders in a corporation. You can consult business attorneys who are knowledgeable in corporate issues to give you more essential information on the matter.

The Role of Negligence in CA Truck Accidents

Among the types of vehicular catastrophes happening California, truck accidents are considered the deadliest and the most fearsome of all. You just have to imagine their gigantic sizes and enormous weight then your may easily predict what would happen after these massive vehicles hit you.

As stated in an article entitled “Facts about Truck Accidents”, people operating trucks and trailers can hardly see the other vehicles and even pedestrians located in some areas beside and behind them. Thus, these drivers’ visibility is limited, making them prone to accidents.

Also given in the composition, are several truck accident causes and proposals on how to prevent or at least lessen its occurrences.

Same as the author has mentioned, I do agree that negligence is a great factor. Like in California, many trucking companies still implement policies that defy the prevailing laws that govern road safety. Instead of training their drivers to enhance their driving skills and installing bumpers on their trucks, some of them focus their attention on how to gain more profit.

Regarding the speed limits, I think that our traffic rules are enough. It is just that a lot of drivers still defy these road warnings and operate their trucks beyond the allowable speed. Consequently, a number of poor accident victims were injured these past years due to the recklessness of these drivers.

Along with the government’s efforts and other transport associations’ advocacy in alleviating the damages resulting from truck accidents, these trucking companies and their employees must follow all the law provisions that aim to protect the welfare of all the road users.

As for the truck accident victims, I do suggest that they take all the available legal options and file their lawsuits against the negligent parties. In doing this, it is necessary to appoint dependable CA truck accident attorneys to have a better chance of acquiring justice.

Remember, these sad incidents will always prevail unless those imprudent drivers have already learned their lessons.
