Tow Truck Destroys Yoshinoya Restaurant after LA Crash

Truck drivers often get tired after hours of driving to and fro the Los Angeles city. This causes fatigue which sometimes reduces the driver's ability to focus on the road and prevent colliding with road objects. Worse, they hit pedestrians and nearby shops.

Just like the accident case of a tow truck which crashed into a Yoshinoya restaurant in West Beverly Boulevard on Thursday.

According to reports, the tow truck carrying a pick up plowed into the fast food restaurant in Wilshire Center. A crew member sustained critical injuries and six others suffered minor injuries.

Paramedics arrived and rushed the four victims to a local hospital. Police officers said that the restaurant's front, tables, and some support beams were damaged. Authorities requested the tenants on the second floor to leave the building until repair was completed.

Driver inattention due to fatigue is considered a negligent act in California. When drivers are dizzy or drowsy they have to pull over and rest for a while to regain strength. They can also call police officers to seek help and prevent collision.

On worse cases, Driving under the Influence (DUI) or speeding aggravate driving condition and result to catastrophic crashes. Both driving violations carry stringent penalties under California law.

It is not yet clear what caused the truck collision, but if the driver pleaded guilty to any of the above traffic law violation examples; he will have to prepare a huge sum for damages payment.

Los Angeles City Council Grants Protection to Cyclists

Cyclists in Los Angeles will have less problems and worries now that the City Council has granted more protection to them.

According to reports, the LA City Council approved an ordinance on Thursday that grants protection to cyclists against harm and harassment on the road. The riders are permitted to file lawsuits against anyone who assaults them.

The ordinance entitles cyclists to receive a minimum of $1,000 or three times the amount of losses as damages. It also allows riders to seek payment for attorney fees, reports said.

The Council's decision was in response to the recent catastrophic bicycle crashes in Los Angeles, including the accident involving Mayor Antonio Villaraigosa.

The new city ordinance seeks to alert vehicle drivers on the importance of giving way to cyclists in order to prevent accidents. It also warns motorists on the possibility of getting sued for misconduct toward cyclists.

This new traffic regulation can give more freedom to bicyclists who are fond of traveling across crowded LA streets. It also gives them additional rights when seeking damages for losses caused by the negligent act of another motorist.

Perhaps providing bicycle lanes to LA residents is not enough for Mayor Villaraigosa. He is determined to teach negligent drivers the legal consequences of hitting riders.

Twilight Star Kristen Stewart Unscathed in LA Collision

Parallel parking is the new trouble of Kristen Stewart as she tries to navigate between cars in Hollywood on Thursday.

The young actress was spotted in Hollywood talking with another woman after a fender bender crash in Los Angeles.

According to reports, Stewart was trying to parallel park when her black Mini Cooper struck the vehicle’s front. She and the other car driver were unhurt after the accident.

Stewart seemed to have difficulty perfecting the S-turn and bumped into the other vehicle. Stewart, nevertheless, was cooperative in exchanging information with the other party, reports said.

Good thing "Bella Swan" was able to get out of her Mini Cooper unscathed. She was also able to show her insurance policy that helped seal the conversation with the other driver. She may not be an expert at parking her car, but she is a financially responsible motorist.

Purchasing an insurance policy for your new car is important as well as mandatory under California driving laws. To prove, the Department of Motor Vehicles (DMV) will ask for your insurance certificate before granting or renewing your driver’s license. When police officers caught you without one on LA streets, it can mean a traffic ticket plus legal consequences.

If you experience a similar fender bender crash with another driver who does not carry insurance to cover your injuries or car damage, you can consult a lawyer to help you.

Your Personal Injury attorney in Los Angeles will assist you in filing an Uninsured/Underinsured Motorist insurance claim or file a formal lawsuit. For more information, dial our toll free number at 1-866-772-2889 or email us at info@mesriani.com for a free case analysis.

Mom Donates Her Dead Son's Organs after LA Odom Crash

The mother of the deceased teenager in the LA Odom crash has donated her son’s organs to Elmhurst Hospital on Friday.

According to reports, the mother decided to donate the organs before proceeding with the burial.

She was beside his son when the boy succumbed to his injuries. The teenager was initially listed in critical condition after a motorcycle-car chain crash in Queens, New York on Thursday, reports said.

Reports said LA Lakers forward Lamar Odom was a passenger in his Cadillac Escalade when his driver hit a motorcycle. The rider then struck the teen pedestrian. The boy fell head first on the ground. Paramedics arrived and transported him to Elmhurst Hospital, where he died the following day.

The mother might have hoped to still see his son. Donating the organs could have been the only way to longing.

The LA Lakers basketball star expressed his condolences to the boy’s family. It is still unclear whether he was cited for the accident.

In a chain crash, the involved parties can be held liable according to the percentage of their fault. If the defendants committed negligent acts that triggered the collision and resulted in injuries, the court will determine the damages accordingly.

The court may also look into other factors that triggered the crash such as the pedestrian’s violation of a traffic law. In this case, the court will have to reduce the damages which may be awarded to the plaintiff.

Bicyclist’s Death in Fontana Blamed on Metrolink Negligence

Riding alone at night is dangerous especially when crossing railways in Southern California.

Take the example of a 15-year-old cyclist who was killed after an eastbound Metrolink train struck him in Fontana on Friday.

According to California Highway Patrol (CHP) reports, Ricardo Lizarraga was riding his bicycle across the railway when the train hit him. He died instantly after the crash.

CHP reports mentioned no other injuries. Authorities are investigating whether Lizarraga have ignored the warning signals when the accident occurred. Police also inspected Metrolink's crossing gates.

Bicyclists tend to ignore warning signals or slip through the crossing gates just to cut time. At other times, riders are negligent in obeying the safety laws.

Committing a negligent act can affect future claim on damages when the family members seek compensation for losses. The court may also nullify the premises liability claim.

However, if the plaintiff can prove that the Metrolink officials have been negligent in ensuring the proper condition of the safety equipment at the time of crash, the court may award damages.

In establishing the negligent act of a government official, the plaintiff has to:

1. Prove that the defendant has failed to exercise duty of care, leading to accident.
2. Establish that the accident caused serious or fatal injuries.

To support their claim, the plaintiff or surviving family members can present photos from the accident scene, witness statements, and medical records to substantiate the case.

California Ranks Fourth on Most Expensive Auto Service State Study

According to a recent national survey, California car owners pay 11% more on auto service fees than 49 other states.

The results are not surprising as California residents have to cope up with high cost of living, demanding labor fees, and expensive auto parts.

The CarMD.com Corporation released the survey results, showing California as fourth among US states to charge additional auto service fees. The Golden State has charged customers 20% more on labor fees and 7% more on replacement parts, reports said. Cal has outbeat 46 other states in collecting higher service fees.

Reports said Arizona ranked number one in the survey, collecting 18% more on repair fees. New Mexico followed by 14% and Colorado by 12%.

The CardMD.com Corporation is an auto information company which partners with more than 80,000 car repair shops in the United States to produce car trends update and data.

The results are quite predictable as most of car owners dwell in the Golden State to take advantage of higher paying jobs. Ironically, the high cost of living and expensive auto repair fees make one’s pocket essentially empty. Perhaps a taste of the nation’s finest living can make a Cal resident say, “It’s worth it”.

However, even after you’ve spent hundred of dollars for car repair and the vehicle still won’t work, you may file a complaint to your dealer. Or, if you’ve suffered injuries caused by the faulty auto part, you may file a Product Liability lawsuit and seek compensation.
