Alleged Drunk Driver Hits a Stalled Car, 1 Dead

A man seated in his silver Toyota Camry in the No. 1 lane with hazard lights on was killed after an alleged drunk driver plowed him on the westbound Artesia (91) Freeway yesterday morning.

The unidentified male victim, who is in his 20s, was declared dead on the scene.

The 20-year old woman, who was driving the black Volkswagen Jetta, was apparently on a high-speed when the accident occurred at around 1:10 a.m. just east of Knott Avenue, California according to Highway Patrol Officer Brian Gonzalez.
She was later arrested on suspicion of driving under the influence. The woman and her male passenger were suspected to be drinking at bars in Fullerton, officers said.

Is the woman reckless or negligent? Drunk driving and overspeeding are considered violations of California driving laws, which constitute negligence. Under personal injury law, negligence can be a basis for holding the offending party responsible for causing injuries to his victim in a car accident. It also entitles the victim to recover damages from the liable party in the accident.

In this case, the woman who was apparently driving under influence (DUI) is clearly negligent unless otherwise she could cite other factors to blame for the accident.
